My PayPal account was hacked, and as a result I won't be taking any orders pending an investigation by PayPal. However, in the interest of full disclosure, I wanted to inform all of you about it. There was absolutely no exposure to any customers who have placed orders online. In fact, that's the very reason I chose to use PayPal - I don't have access to your credit card numbers.

I want to repeat that, because it's very important. Whoever hacked into my account cannot steal your credit card information because that information doesn't appear anywhere in my account. The beauty of PayPal is that orders are about as anonymous as you can make it. I don't get any information about credit cards, bank accounts, etc. The only thing I see is who you are and what you ordered.

So, you're still safe with me. Once the PayPal investigation is complete, I will close my account and create a new one. That should take about 10 days. From there, I'll be able start accepting online orders again.

However, if you have any questions at all, please, please, please e-mail me. I will be happy to answer any questions that I can.

theft of intellectual property, or my pictures on your facebook

I'm a member of several online communities for photographers, and theft of intellectual property is a topic that comes up on almost a daily basis. The only topic that comes close in frequency is "educating your clients". So, I'm going to try to roll these two into one for a nice little post. So, here goes.

The law says that the copyright to any photograph taken stays with the photographer unless explicity transfered. This means that I own the rights to any picture that I take, even if it's a picture of you. You can't use it, sell it, or make copies of it without my express permission.

Likewise, the law says that use of an image depicting a person cannont be used for the promotion of a business or product without the express permission of the person depicted. This means that I can't sell a picture of you to, say, Nike, for them to use in selling shoes without your permission.

The exception to this is editorial usage. If the Perry Daily Journal wants to use one of my pictures for an article in the paper, they don't have to have permission from you or me, as long as they give credit for the photo.

Crazy, huh?

So, the whole reason I'm even bringing this up is because a parent mentioned to me that one of their children had a number of my pictures up on their Facebook page (it's ok, Brandon). Personally, I think that's awesome, but not all photographers would agree. So, be careful when you do that. It probably won't get you sued, but it might get you a nice "cease and desist" letter asking you to remove the pictures.

Now, I watermark all of my pictures online so that other people can't claim that a picture is theirs. It also means that if you're using one of my online pictures, there's a good chance it will drive more people to my website. So, you're actually promoting me, which is great.

I want to reiterate that I'm cool with this. In fact, to show how cool I am with it, I want to make you an offer. If there are sports pictures of you in my gallery that you want for Facebook or Myspace, email me with the file names and I'll move the watermark to the bottom of the picture so it doesn't cover you up.

So, here's how to do it (with pictures):

1) Right-click on the picture, and select Properties
2) Right-click on the text to the right of the Address (URL), and select Select All
3) Do the same as number 2, but this time select Copy
4) Now, paste that text into an e-mail to tyson@tysondavis.com
5) Make the subject of the e-mail Pictures for Facebook or Pictures for Myspace

And, that's it. It might sound complicated, but I promise it's not. If you can save the pictures to your computer, you can do this. I'll try to get the pictures back to you as soon as I can.

9th grade basketball

The pictures of the 9th Grade basketball games against Kingfisher are now available in the Tip-In Club portfolio. I'm sorry that I didn't get a chance to shoot more of your games this year. I think there was a bit of a mix-up. For now, enjoy these photos and hopefully I'll be able to shoot more next season.
